1. General
1.1 In these terms and conditions (the "Terms and Conditions"), “My Care Healthcare Limited.” or “we” or “us” means the operator of this online store, and “customer” or “you” means any person or entity placing an order with us. By using our online store (the “Online Store”) or any part of it, you agree that you have read, understood and agree to be bound by these Terms and Conditions.

1.2 We make every reasonable effort to ensure that prices, product details and sizes listed on the Online Store are up-to-date and accurate. However, prices and information are subject to change without prior notice and all orders are subject to our final acceptance and stock availability.

1.3 While we endeavour to keep sufficient stock, all products are offered subject to availability. In the event that any product you ordered is out of stock, we reserve the right to offer an alternative product of similar value and nature, or to cancel the item and arrange refund for that item only.

1.4 All orders are subject to confirmation of final availability. We reserve the right to reject any order if the requested products or services are unavailable or for any other reasonable grounds (including but not limited to payment issues, suspicious or repeated bulk orders, etc.).

2. Minors
2.1 You acknowledge that you are at least 18 years old and are fully able to understand, agree to and comply with these Terms and Conditions. If you are between 13 and 18 years old, you may only use the Online Store under the supervision of a parent or legal guardian who agrees to be bound by these Terms and Conditions. If your parent or legal guardian does not agree, you must stop using the Online Store.

3. Personal Information
3.1 You acknowledge and agree that, for the purposes of processing and following up your orders, arranging delivery, handling after‑sales enquiries and other directly related purposes, we will collect, use and process the personal information voluntarily provided by you, including but not limited to your name, phone number, email address, delivery address, purchased products, prices and order dates.

3.2 If you place an order for another person, you confirm that the recipient has authorised you to provide his/her personal information (including name, phone number and delivery address) to us for order and delivery purposes.

3.3 To deliver the products to you or to the recipient designated by you, we may share the necessary personal information with our third‑party logistics and payment partners on a need‑to‑know basis only. Such partners are contractually required to keep the information confidential and use it solely for providing the relevant services.

3.4 Please read our Privacy Policy carefully to understand how we collect, use, store and disclose customer information.

4. Payment
4.1 The Online Store accepts payment via designated credit cards and/or other electronic payment methods as specified at checkout. All prices are listed in Hong Kong Dollars (HKD). Prices displayed on the Online Store may differ from prices offered via other sales channels. The applicable price shall be the price shown on the Online Store at the time of purchase.

4.2 Acceptance of your order is at our sole discretion. A final receipt or electronic invoice will be issued after successful payment and dispatch.

4.3 To provide secure online transactions, we employ industry‑standard encryption technology (such as Transport Layer Security, TLS) so that your payment information (including credit card number, name and address) is encrypted during transmission over the Internet.

5. Supply of Goods
5.1 We supply products to end consumers only and do not sell for re‑sale or wholesale purposes. If we have reasonable grounds to believe that you are not purchasing for personal use (for example, repeated bulk orders of the same item), we reserve the right to decline or cancel your order.

5.2 Title to the products shall remain with us until we have received full payment. Risk in the products will pass to you upon delivery to the address you provided or upon self‑collection (as the case may be).

5.3 If the ordered products remain undelivered or uncollected due to reasons attributable to you for more than 7 days from the date of our first delivery attempt or collection notice, we reserve the right to cancel the order and dispose of such products at our discretion without further notice. In such event, no refund or compensation will be made.

5.4 You agree to use the Online Store in a lawful and honest manner. We reserve the right to refuse service, cancel orders or terminate accounts where we reasonably suspect illegal, abusive or fraudulent activities (including but not limited to payment fraud, misuse of promotions, repeated unreasonable refusal to accept delivery, etc.).

6. Payment Terms
6.1 We currently accept the payment methods as displayed on the checkout page (for example: Visa, MasterCard, American Express, FPS, or local digital wallets). The list of accepted payment methods may be updated from time to time.

6.2 You must use a valid payment method issued under your own name and ensure that you are authorised to use such payment method for the transaction.

6.3 Where delivery or handling charges apply, such charges will be shown separately for your review and confirmation before you proceed to payment.

7. Ordering
7.1 Our Online Store currently only accepts orders for delivery within Hong Kong to designated areas as specified in our Delivery Policy.

7.2 Placing an order means that you make an offer to purchase products in accordance with these Terms and Conditions. After receiving your order, we will send an acknowledgement email. This acknowledgement does not constitute acceptance of your order. We reserve the right to reject any order without giving reasons, for example in case of payment issues, incorrect information or product unavailability.

7.3 Once an order has been confirmed and payment has been made, no changes, cancellations or refunds will be entertained, except as provided under the “Exchange and Refund” section below or otherwise required by applicable laws.

7.4 If your order is accepted, we will confirm with you by email or other electronic means and provide details of the delivery arrangement.

8. Delivery Service
8.1 You may enjoy free delivery to a single Hong Kong address when your order amount reaches the minimum amount specified on our Delivery Policy page. For orders below such amount, a delivery fee will be charged as shown at checkout.

8.2 Delivery service is available only to designated areas in Hong Kong. Some remote or restricted areas may not be covered, or may be subject to additional surcharges and/or longer lead time. Please refer to our Delivery Policy or contact us for details.

8.3 Once your order is confirmed and payment is received, we will arrange delivery to your specified address within the estimated time frame indicated on the Online Store (excluding Sundays and public holidays). The estimated delivery date is for reference only and may be affected by factors such as weather, traffic, peak seasons or other circumstances beyond our reasonable control.

8.4 Delivery service is not available to locations where access is legally restricted or where our logistics partners consider unsafe or impractical.

8.5 Upon delivery, please check the items against the invoice or delivery note and ensure that the packaging of chilled or frozen foods remains intact and at appropriate temperature (for example, frozen foods should remain hard‑frozen upon arrival). Any issues should be reported to us within the time frame stated in our Exchange and Refund Policy.

8.6 In case of typhoon signal No. 8 or above, or red/black rainstorm warning, delivery may be suspended or delayed. We will contact you to rearrange delivery where applicable.

8.7 If you fail to receive the products at the agreed delivery time, or if the delivery information provided by you is inaccurate or incomplete, resulting in unsuccessful delivery, we may charge an additional delivery fee for re‑delivery and cannot guarantee product quality (especially for chilled or frozen items) for subsequent deliveries.

8.8 All expected delivery dates are estimates only. We shall not be liable for any loss or damage suffered by you as a result of any delay in delivery, to the maximum extent permitted by applicable law.

9. Exchange and Refund
9.1 Due to the perishable nature of chilled and frozen foods, we generally do not accept returns or refunds for products that have been successfully delivered and are not defective. However, if products are found to be damaged, spoiled, wrong item delivered, or of serious quality issue upon delivery, you may contact our customer service within 3 days of receipt (based on delivery date) to request an exchange or further handling.

9.2 When reporting a quality issue, please keep the products (including any outer and inner packaging, batch labels and remaining contents) in proper storage conditions and provide photos or other supporting information as we may reasonably require for investigation.

9.3 If we agree that you are entitled to an exchange but the same product is out of stock, we may, at our sole discretion, offer one of the following options:
(a) exchange for another product of equal value; or
(b) refund the amount paid for the affected product to your original payment method.

9.4 In exceptional cases and at our sole discretion, we may arrange a refund to your credit card or bank account. Processing time may vary depending on the bank or payment provider.

9.5 For any exchange or refund request, you must provide the original sales receipt or relevant electronic proof of purchase. All promotional gifts or free items included with the original order must be returned together; otherwise, the retail value of such items may be deducted from any refund amount.

10. Copyright and Intellectual Property
10.1 Unless otherwise stated, all content on the Online Store, including but not limited to text, graphics, logos, photos, product descriptions and software, is protected by copyright, trademarks and/or other intellectual property rights owned or licensed by My Care Healthcare Limited. All rights are reserved.

10.2 You may use the Online Store and its content for personal, non‑commercial purposes only. You agree not to reproduce, distribute, publish, transmit, modify, display, create derivative works from, or otherwise exploit any content from the Online Store without our prior written consent.

10.3 The Online Store may contain links to third‑party websites which are not operated or controlled by us. These links are provided solely for your convenience and do not imply our endorsement of the content. We are not responsible for the content or practices of any linked sites and you access them at your own risk.

11. Indemnity
You agree to indemnify, defend and hold harmless My Care Healthcare Limited , its affiliated companies, directors, officers, employees, agents and service providers from and against any and all claims, losses, liabilities, damages, costs and expenses (including legal fees on a full indemnity basis) arising out of or related to your use or misuse of the Online Store, your violation of these Terms and Conditions, or your infringement of any rights of a third party.

12. Warranties and Disclaimers
12.1 The Online Store and all information, content and services provided are offered on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, we make no representations or warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, reliability, non‑infringement, or that the Online Store will be uninterrupted, error‑free or free of viruses or other harmful components.

12.2 We do not guarantee that any particular product will always be available, or that the quality of any products, services, information or other material purchased or obtained by you will meet your personal expectations, provided that they comply with applicable food safety standards and our product descriptions.

12.3 We reserve the right to suspend, modify or discontinue the Online Store (in whole or in part) at any time without prior notice for maintenance, update, security or other legitimate business reasons.

13. Limitation of Liability
13.1 To the maximum extent permitted by applicable law, in no event shall My Care Healthcare Limited or its affiliated companies be liable to you for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, goodwill, data or other intangible losses arising out of or in connection with your use or inability to use the Online Store or any products purchased through it.

13.2 Without prejudice to the above, and to the extent permitted by applicable law, our total aggregate liability to you in respect of any claim arising out of or in connection with a particular order shall not exceed the total amount actually paid by you for that order.

13.3 Nothing in these Terms and Conditions shall exclude or limit any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our negligence.

14. Amendments to These Terms and Conditions
We reserve the right to amend these Terms and Conditions from time to time. The updated version will be posted on the Online Store with the effective date. Your continued use of the Online Store after the effective date of any amendments will constitute your acceptance of the updated Terms and Conditions.

15. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict of laws rules. You agree to submit to the non‑exclusive jurisdiction of the Hong Kong courts for any disputes arising out of or relating to your use of the Online Store or these Terms and Conditions.

In case of any inconsistency between the English and Chinese versions of these Terms and Conditions, the English version shall prevail.

1. 一般條款
1.1 在本條款及細則(下稱「本條款」)中,「幸福元氣有限公司」、「本公司」或「我們」是指本網上商店的營運方,而「客戶」或「您」是指任何在本公司網上商店提交訂單的人士或機構。您使用本網上商店(下稱「網店」)或其中任何部分,即表示您已閱讀、明白並同意受本條款約束。

1.2 我們會盡合理努力,確保網店內列出的產品價格、資料及尺寸等資料準確及最新;惟所有資料及價格如有更改,恕不另行通知,所有訂單須視乎我們最後確認及存貨供應情況而定。

1.3 雖然我們會盡力保持充足存貨,惟所有產品均以實際供應情況為準。如任何已訂購產品缺貨,我們有權就相關貨品:

取消該項產品並安排退款;或

在取得您同意後,以相若價值及性質之其他產品代替。

1.4 所有訂單均須以產品或服務最終可供應情況為準。如因任何原因(包括但不限於付款問題、懷疑不當使用、系統錯誤等)未能提供訂購之產品或服務,我們保留拒絕或取消任何訂單之權利。

2. 未成年人
2.1 您聲明及保證您已年滿18歲,並有完全行為能力理解及遵守本條款。
2.2 如您年齡介乎13至18歲,須在已同意受本條款約束之父母或監護人監督下使用網店;如其不同意,您必須停止使用網店。

3. 個人資料
3.1 您了解並同意,為處理及跟進您的訂單、安排送貨、提供售後服務及其他直接相關用途,我們會收集及處理您自願提供的個人資料,包括但不限於:姓名、聯絡電話、電郵地址、送貨地址、所購買產品名稱、金額及訂單日期等。

3.2 若您為他人下單,您確認及保證已獲該名收件人同意,向本公司提供其個人資料(包括姓名、電話及送貨地址),並授權本公司為處理訂單及送貨之目的使用該等資料。

3.3 為向您或您指定的收件人送貨,我們或需向第三方服務供應商(例如物流公司、支付服務供應商)披露相關及必要的個人資料,上述合作夥伴須根據合約承諾保密及只為相關服務之目的使用該等資料。

3.4 有關我們如何收集、使用、儲存及披露個人資料的詳情,請細閱本公司之《私隱政策》。

4. 付款
4.1 網店現接受之付款方式,以結帳頁面當時顯示為準(例如:指定信用卡、本地電子支付等),所有價格均以港幣計算。網店價格有可能與其他銷售渠道有所不同,一切以您下單時網店顯示之價格為準。

4.2 所有訂單最終接納權由本公司全權酌情決定。當付款成功並由我們確認訂單後,我們會向您發出電子收據或訂單確認通知。

4.3 為保障網上交易安全,我們會使用業界通行的加密技術(例如 TLS)在互聯網傳送付款資料(包括信用卡號碼、姓名及地址等),以降低資料在傳輸過程中被未經授權人士讀取的風險。

5. 供貨及使用限制
5.1 本公司只向最終消費者供應產品,並非以轉售或批發為目的。如我們有合理理由相信您並非作自用(例如重複大量訂購相同貨品),我們保留拒絕或取消訂單的權利。

5.2 在我們收到有關訂單的全部款項前,產品所有權仍屬本公司;當產品送達您提供的送貨地址或完成自取後,產品風險即轉移至您。

5.3 如因客戶原因導致貨品未能成功送達或未於指定期限內領取(例如:無人收貨、地址錯誤或不完整、未有按時自取等),而相關貨品自首次送貨/通知起計超過7天仍未成功送達或領取,本公司有權取消訂單及按情況銷毀或處置貨品,恕不另行通知,亦不設任何退款或賠償。

5.4 您同意不會以任何違法、不誠實或欺詐方式使用網店。我們如發現或合理懷疑存在濫用、欺詐、洗黑錢、騷擾、惡意下單或其他不當行為,有權取消相關訂單、暫停或終止提供服務。

6. 付款條件
6.1 您須使用屬本人及有效之付款工具,並確保有足夠信用額或結餘支付相關款項。

6.2 如訂單需收取送貨或其他附加費用,有關金額會於結帳前清楚列明,並讓您確認後才進行付款。

7. 訂購程序
7.1 網店目前只接受送往香港指定地區的訂單,實際送貨範圍以本公司最新公布為準。

7.2 當您於網店提交訂單,即表示您按當時列明之價格及條款向我們發出購買要約。我們接收訂單後,會向您發出確認收妥訂單的通知,但該通知並不代表我們已接納訂單。我們保留因任何原因拒絕訂單的權利,例如付款未獲授權、資料有誤、貨品無法供應等。

7.3 除本條款另有說明或法例要求外,訂單一經付款及確認後,恕不接受更改、取消、退貨或退款。請在確認訂單前仔細核對所有資料。

7.4 當我們接納您的訂單後,會以電郵或其他電子方式向您發出訂單確認及送貨安排。

8. 送貨服務
8.1 如訂單金額達到我們不時訂明的免費送貨門檻,即可享用免費送貨服務;如未達門檻,則需支付相應送貨費用,具體金額以結帳時顯示為準。

8.2 送貨服務只限本公司指定地區,部分偏遠地區或限制區域可能不提供服務,或需額外附加費及較長送貨時間,詳情請參閱送貨政策或向我們查詢。

8.3 在訂單確認及成功付款後,我們會按網店所示之預計時間安排送貨(不包括星期日及公眾假期)。預計送貨時間僅供參考,實際到貨時間可能因交通、天氣、物流或其他我們不能合理控制的因素而有所延誤。

8.4 送貨服務不適用於政府限制出入或物流公司認為不安全/不適合送貨之地點。

8.5 請於收貨時即場檢查貨品是否正確、數量是否相符,以及包裝是否完好,尤其是冷凍及冷藏食品,應確認其外包裝完整,及處於適當溫度(例如急凍食品應維持硬身凍結狀態)。如有任何問題,請在本公司退換政策所列明之時限內向我們反映。

8.6 若懸掛八號或以上熱帶氣旋警告信號,或發出紅色/黑色暴雨警告,送貨服務或會延遲或暫停,我們會再與您聯絡另作安排。

8.7 如因您提供錯誤或不完整的送貨資料、收件人無人應門、拒收等因素導致送貨失敗,我們可能收取額外費用以安排再次送貨,並不保證冷藏或冷凍食品在再次送貨時仍維持最佳品質。

8.8 所有送貨日期及時間僅為預計,本公司不會就任何送貨延誤而引致的損失或損害承擔責任,在法律允許的最大範圍內適用。

9. 換貨及退款
9.1 由於冷凍及冷藏食品屬易變壞貨品,一般情況下,在成功送貨且品質無異常後,恕不接受因個人口味、選購錯誤、保存不當等原因而提出之退貨或退款申請。

9.2 若您收貨時發現產品有以下情況之一:

嚴重損壞或破裂;

明顯變質或懷疑品質問題;

收到貨品與訂單不符;
請於收貨後3天內(以送貨日期起計)聯絡客服,並提供相關照片及證明,我們會按情況為您跟進及安排更換或其他處理方案。

9.3 當您提出品質問題時,請暫時保留相關產品(包括外箱、內包裝、標籤及剩餘內容物),並以適當條件冷藏或冷凍保存,以便我們或供應商作進一步調查。

9.4 如經確認需更換貨品而原貨已缺貨,我們可酌情提供:
(a) 更換為同等價值之其他產品;或
(b) 就有問題產品之貨款安排退款至原來付款方式。

9.5 在個別特殊情況下,本公司可全權酌情決定是否安排退款及具體方式。退款處理時間視乎銀行或支付服務供應商情況而定。

9.6 申請換貨或退款時,您必須出示訂單號碼、電子收據或其他購買證明。凡訂單附送之贈品或優惠品,必須一併退回,否則本公司有權從退款中扣除該等物品之零售價。

10. 版權及知識產權
10.1 除另有說明外,網店內所有內容(包括文字、圖片、標誌、圖像、介面設計及其編排等)之版權及/或其他知識產權均屬本公司或其授權人所有。

10.2 您只可將網店資料作個人、非商業用途。未獲本公司事先書面同意,您不得以任何形式複製、分發、公開展示、改編或以其他方式利用本網店之任何內容。

10.3 網店內可能載有連結前往第三方網站。該等網站並非由本公司營運,我們對其內容或私隱政策不負責,您進入該等網站須自行承擔風險。

11. 彌償
您同意,如因您使用或誤用網店、違反本條款或侵犯任何第三方權利而引致或與之相關的任何索償、損失、損害、責任、費用及支出(包括全面彌償基準的法律費用),您將向本公司、其關聯公司、董事、管理層、僱員及代理作出彌償,並使其免受損害。

12. 免責聲明
12.1 本公司按「現況」及「可提供」基礎提供網店及所有相關資訊及服務。在適用法律允許的最大範圍內,我們不就網店或其內容作出任何明示或默示聲明或保證,包括但不限於適銷性、適合特定用途、準確性、可靠性、不侵權、不中斷、不含錯誤或病毒等。

12.2 在符合適用食品安全法例及本公司產品標示的前提下,我們不保證任何產品必然符合個別人士的主觀期望(例如口味、口感等)。

12.3 我們保留隨時因維護、系統更新或其他合理業務原因,暫停、修改或中止全部或部分網店服務之權利,而無需事先通知。

13. 責任限制
13.1 在適用法律允許的最大範圍內,無論基於合約、侵權(包括疏忽)、或其他法律原因,本公司及其關聯公司在任何情況下均不會就您使用或無法使用網店或經網店購買之產品所引致的任何間接、附帶、特別、懲罰性或後果性損害承擔責任,包括但不限於利潤損失、商譽損失、資料遺失或其他無形損失。

13.2 在不違反上述規定及法律允許的前提下,就任何單一訂單而引起的所有索償,本公司對您承擔的總責任以您為該訂單實際已支付的金額為上限。

13.3 本條款並不排除或限制任何法律上不得排除或限制的責任,包括因本公司疏忽而導致人身傷亡的責任。

14. 條款修訂
本公司有權不時修訂本條款。一經於網店上載更新版本並註明生效日期後,更新後條款即時或於指定日期起生效。您於該生效日期當天或之後繼續使用網店,即被視為已接受更新後之條款。

15. 準據法及司法管轄
本條款受中華人民共和國香港特別行政區法律管轄並依其詮釋,而不適用其法律衝突原則。您同意將任何因使用網店或本條款而產生或與之相關的爭議,提交香港法院具有非專屬司法管轄權審理。

如中英文版本有任何歧異,一概以英文版本為準。
